PARK PLACE AT OREM HOMEOWNERS ASSOCIATION
OFFICIAL RULES AND REGULATIONS

Paragraph references are to the Declaration of Covenants and to the By-Laws
1.         APPLICABILITY. All present and future owners and tenants or other persons using the facilities are subject to and must comply with these rules and regulations which replace earlier editions. At time of purchase, all owners accepted and agreed to abide with provisions of priority documents: (1) Declaration of Covenants, Conditions, and Restrictions and (2) By-laws of the Association. These rules and regulations conform with those documents. Total compliance will enhance property values. (Ref. 13.1)
2.         VIOLATIONS AND POSSIBLE FINES. Failure to follow rules may lead to a citation (violation notice issued by the Board) with notice of a $10 fine if not corrected by a certain date. Continued violation leads to successive fines. Fines are assessed on landlord owners not on tenants who may have committed the violation. Fines should be paid promptly. If ignored, payment will eventually be made due to continuing lien provisions. When Orem City ordinance or zoning are involved, Orem City agencies assist in enforcement. Prior failure by the Association to enforce any rule, covenant, or restriction does not preclude current or future enforcement. Individual directors (board members) cannot speak for the Board nor give concessions; only a quorum of directors in a board meeting can do so. (Ref. Art. VII 1, f. By-Laws)
3.         SINGLE FAMILY RESIDENTIAL USE ONLY. Park Place is a single-family development. Orem City zoning rules apply. The term ”single-family” is defined as either 1) the owner and all persons related to the owner, 2) the person to whom the owner has leased the dwelling and all persons related to the lessee, or 3 (three) unrelated individuals.  Owners who rent or lease are required to follow this zoning rule. Violators to this city ordinance will be reported to the city. (Ref.  11.1)
4.         NO COMMERCIAL USE. No dwelling, garage, parking or common area will be used for commercial purposes by owners or tenants. (Ref. 11.1)
5.         MONTHLY DUES. The unit owner is responsible for on-time payment of common and special assessments. Presently monthly dues are $100/month. ($90 common assessment plus $10 capital reserve fund).  Payment may be by mail (PO Box 819, Orem, Utah 84059), by using the association box located near the cluster of mail boxes, or can be sent using a bill-pay system.  Dues must be recieved by the first day of the month.  After the 15th of each month, the dues are considered late and the owner will be fined.  (Ref. Art. XI, By-Laws)
5.         SALE, LEASE, OR RENTAL OF UNIT. A selling owner is responsible for payment of dues for the entire month in which closing occurs. The unit owner will provide to the agent at time of listing a copy of these rules for his orientation and delivery to the new owner. An owner will also provide a copy of these regulations to renters (Ref. 3.2)
7.         INSURANCE. The unit owner is required to keep in full force standard fire and extended risk insurance on his/her unit and personal property to include broad form comprehensive liability coverage often call "homeowners policy". The certificate of insurance will designate Park Place Homeowners Association as an "additional insured". The term "other insured" is used by some insurers and is acceptable. A copy of the certificate must be furnished to the Association. (Ref. 7.3)
8.         COMMON AREAS. The unit owner lot includes only the Land under the residence, backyard/patio, and garage. All other land and improvements constitute the common areas totally within Association control and management. Even though the Association encourages owners to plant flowers in front of their unit(s), the Association owns and is responsible for all plants, shrubs, and trees. All residents are to enjoy the common areas, and unit owners have a right and easement in and to the common area. Common areas are not to be used for storage of supplies or personal property. (Ref. 1.3)
9.         PARKING. Each owner is provided with space for two motor vehicles. For 26 owners these spaces are within their double garage. Owners of 11 single garage units each have one additional numbered curb space assigned for their exclusive use. Garages will not be diverted to any use which results in the owner parking vehicles in curb space(s) instead of in the unit's garage. Curb marking is done by the Association. Curb parking on both sides of 165 South Street is open to all and is subject to Orem City control. Parking on both sides of 70 West Street including the corners is prohibited as is parking which blocks access to any garage, other vehicles, or dumpsters. Two spaces near the mail box cluster are marked for visitors only and are not to be used by owners or other residents. Parking along the west perimeter fence may be used only with written consent of the Board, with the exception of the "Visitors Only" spaces. The total common area is a tow-away zone (after notice to the owner) for disabled or unlicensed (no current state registration) vehicles. (Ref. 3.2)
10.       RIGHT TO PEACE, QUIET, AND PRIVACY. All occupants should help maintain an environment free from excessive noise and offensive behavior. From 10 PM to 7 AM social gatherings and other activities must be conducted in a manner which respects the right of neighbors. Orem police should be called if peace is disturbed. (Ref. 11.2)
11.       DANGEROUS PRACTICES AND ACTIVITIES. No resident or guest will permit anything to be kept or done in his/her house, yard, or garage which creates a hazard for others or a situation which could increase insurance costs for other owners or the Association. Explosives or flammable materials will not be stored in garages with exception of gasoline in vehicle fuel tanks. (Ref 11.3)
12.       PETS. No animals other than household pets (cats or dogs) are permitted and are limited to one per unit. Pets will have care and restraint to prevent offensive noise, odor, or unsanitary conditions. Orem City leash law applies. (Ref. 11.6)
13.       USE OF GARBAGE DUMPSTER. All refuse must be bagged or boxed to prevent littering when dumpster is emptied. Large empty boxes must be flattened. Nothing should be left in the enclosure which must be left clean and clear. (Ref. 3.2)
14.       SIGNS. Signs or advertising devices are not to be posted on the common areas or attached to any building. "For Sale" signs may be placed inside the unit in any window. (Ref. 11.4)
15.       PLAYING IN COMMON AREAS. Owners and parents are responsible for supervision, conduct, and safety of their children and guests. Playing is permitted only on lawns, basketball court, and sidewalks. Playing on other paved areas (drives and parking space) is unsafe and prohibited but children are unpredictable and drivers should exercise extreme caution when backing out of garages and parking stalls and at building corners. Play in the center lawn area is restricted to use of low impact soft equipment. All play equipment should be removed from the common area overnight or when not in use. (Ref. 3.2)
16.       BACKYARD LANDSCAPING. Backyard landscaping is at the discretion of the owner with two exceptions: (1) Trees are to be limited to ornamentals which will grown no higher than the garage eaves and thus not drop leaves in adjoining yards, or damage roofing. (2) Soil will not be placed in contact with siding. Neglected yards will be cleaned by the Association at the owner's expense. (Ref. 3.2)
17.       REPAIR OF EXTERIOR DAMAGE. If damage is the result of owner/tenant action or negligence, the Owner should promptly restore (repair or replace as required) to original standards. If restoration is not made within 15 days, the Association may do so and charge the owner. All glass and garage door repair or replacements are owner responsibilities. (Ref. 3.2)
18.     BUILDING ALTERATIONS. An owner may not make any exterior alteration to building
appearance without written permission from the Association. Alterations include but are not limited to storm doors, paint color, awnings, and antennas. Orem City will not approve any backyard additions except low decks not to exceed 18 inches high. (Ref. 10.1)
22.       SNOW AND ICE REMOVAL. As a general rule sidewalks, including walks to porch steps, will be cleared by the Association when snow depth reaches three inches; parking and driveway areas when the depth reaches six inches. Other factors impacting on Association decision to clear include budget consideration, unusual weather condition/forecasts, and availability of removal equipment or services. Note that this leaves owners with the responsibility to clear walks when snow amount is less than three inches. The owner or tenant has the responsibility to keep porch steps free of ice. Always have ice melting material available. (Ref. 3.2)
23.       DISPOSING OF KITCHEN GREASE. Hot grease quickly solidifies (year round) in sewer drains and traps. To prevent costly clean-outs, grease should not be poured into sinks or garbage disposals. Allow grease to solidify then dispose of it with other trash. (Ref. 3.2)
23.       ANNUAL GENERAL MEETING OF MEMBERS. It is the responsibility of each owner, in person or by written proxy designation, to attend the annual general meeting of members where two directors are elected, proposals requiring member approval are voted upon, and other Association business transacted. The meeting is held on the second Saturday of June. (Ref. Art. III, By-Laws)
24.       GARAGE/YARD SALES. All garage/yard sales will be organized and supervised by the Board of Directors. Two sales will be held each year - one in the spring and one in the fall. Advanced announcements (including instructions) will be distributed offering sale space to owners and renters who desire to participate. (Ref. 3.2)
25.       PRIDE OF OWNERSHIP IS ESSENTIAL. The Association and its owners individually have important stakes in having the total development maintained in first-class condition thus protecting property values. It is the responsibility of unit owners to keep his/her unit (front doors, porches, patios, backyards, and inside fences, etc.) clean and in good repair and appearance. The Association is responsible to keep building exteriors and the common area in excellent condition. Owners should have a "pitch in and help" attitude to pick up litter and to respond to Association calls for volunteer work projects. Pride of ownership is best demonstrated by total compliance with these rules and regulations. (Ref. 3.2)
